1. ELIGIBILITY

1.1

Velocity Competitions Ltd ( ‘Promoter’, ‘our(s)’) operate competitions – skilled prize competitions resulting in the allocation of prizes in accordance with these Terms and Conditions at www.velocitycompetitions.co.uk (the ‘Website’) – (the ‘Competition(s)’).

1.2

The Competitions are open to all persons aged 18 and over and the age of majority in their country of residence excluding the Promoter’s employees or members of their immediate family, agents or any other person who is connected with any of our Competitions.

1.3

Velocity Competitions Ltd reserves the right to close a customer’s account at any time, if they feel the customer is abusing the services, being abusive to other customers or staff or they have the belief that it is not genuinely the customer that is entering.

1.4

All winners will be determined by a 100% random ball machine, all live draws will be streamed via live feed using Facebook live. No competition(s) will be rolled over or postponed due to insufficient tickets/number sales(unless due to death or any unforeseen circumstances that are considered to be out of the promoters control), under these circumstances the competition will be brought to a close and all entrant fees are to be fully reimbursed

2. LEGAL UNDERTAKING

2.1

By entering a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’) will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2

Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction

2.3

In the event that you participate in a Competition online via the Website, and by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. Velocity Competitions Ltd will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

3. COMPETITION ENTRY

3.1

Competitions may be entered at www.velocitycompetitions.co.uk. Velocity Competitions Ltd may run multiple competitions and may be operated at the same time and each Competition will have a specific prize.

3.2

Availability and pricing of Competitions is at the discretion of Velocity Competitions Ltd and will be specified at the point of sale on the Website.

3.3

In order to enter a Competition, you will need to register an account with us online. When registering an account online you will be asked to provide an email address.

3.4

When playing a Competition online via the Website, follow the on-screen instructions to:
(a) select the Competition you wish to enter and when you are ready to purchase your Ticket(s), provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions;
(b) once you have selected your tickets, complete the skill-based  competition question (wrong answers to this competition will be charged but not entered in the competition), when payment has cleared we will contact you by email to confirm your entry into the Competition.

3.5

Velocity Competitions Ltd reserves the right to refuse or disqualify any incomplete entries if it has reasonable grounds for believing that an Entrant has contravened any of these terms and conditions.

3.6

The Entrant can enter the competitions a maximum number of times as displayed on the individual prize page. The limit is per person. Maximum ticket numbers vary per competition based on number of tickets available/price of tickets.
Abuse of this limit will not be tolerated and if the Promoter has reasonable grounds to believe that an individual is exceeding this limit, for example by entering a Competition using multiple accounts, it reserves the right at its sole discretion to void any orders or to award any prize to the next closest entrant.
In addition, if any person using a single account exceeds 25 entries in a single paid Competition for any reason, the Promoter reserves the right at its sole discretion, to void any tickets without notice firstly on a chronological basis with respect to orders, and then on a sequential basis with respect to ticket references contained within an order, so as to void any tickets exceeding the first 25 paid tickets entered into the Competition.

3.7

To the extent permitted by applicable law, all Entries become our property and will not be returned.

3.8

The competition closes when the last number is taken, no more entries after this point will be accepted. We will also close a competition early if it does not sell out by the guaranteed draw date, ticket sales will close and we will draw the prize regardless of how many tickets are sold on the guaranteed draw date.

3.9

All entrants must create an account prior to entering, and supply an email address and contact telephone number to proceed in the competition.

3.10

A postal entry route is available by entering the competitions in the following way:

3.10.1

Via the Website select the competition you wish to enter to view the Competition Question.

3.10.2

Send an unenclosed postcard to Velocity Competition, 18 School Lane, Kirkheaton, Huddersfield HD5 0JS.

3.10.3

The full complete name/title of the competition that you wish to enter.

3.10.4

Your full name and postal address.

3.10.5

Telephone number and email address.

3.10.6

Your date of birth.

3.10.7

Your answer to the Competition Question.

3.10.8

Agree that you accept the terms and conditions and our privacy policy.

3.11

Important Information regarding entries

3.11.1

Postal entries are limited to one per household per competition.

3.11.2

Postal entries must be received by the Promoter before closing date. Any postal entries received after this date will not be processed and correct entries will not be entered into the draw.

3.11.3

If Postal entries are received after the competition is closed, they will not be processed.

3.11.4

It is the Entrant’s sole responsibility to ensure that their entry is received by the Promoter in advance of the deadline.

3.11.5

The Promoter is under no obligation to confirm whether or not an entry was received prior to the deadline or whether the Entrant’s answer to the Competition Question was correct.

3.11.6

Any Postal entry not complying with the entry requirements contained in clause 3.10 shall be disqualified and not entered into the draw.

Ticket number will be selected at random by the promoter

3.12

All entries must be submitted in the English language. Entries in languages other than English will automatically be disqualified and no refund will be given.

3.13

We are under no obligation to correspond regarding postal entries

3.14

The Promoter will not accept responsibility for competition entries that are not successfully completed, are lost or are delayed regardless of cause, including, for example, as a result of any postal delays, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.15

By purchasing entries and submitting a competition entry, you are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions.

3.16

All winners will be identified and address verified, if they have used an address to get around our rules then no prize will be awarded and the draw will be redrawn.

3.17

By submitting your entry and any accompanying material, you agree to:
(a) assign to the Promoter all your intellectual property rights with full title guarantee; and
(b) waive all moral rights in and to your entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

(c) SMS Consent, by registering on our website you agreed to be contacted by SMS in the future.

3.18

3.18 You agree that the Promoter may, but is not required to, make your entry available on the Website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the entry and any accompanying materials for such purposes.

4. PROMOTION PERIODS

4.1

Once a prize draw date has been called and confirmed on the prize listing page, we will draw the prize on that date regardless of ticket sell out. Once a guaranteed draw date is set, we will not extend a competition.

5. COMPETITION JUDGMENT

5.1

100% random ball machine will determine the winner of each competition. Every draw will be live streamed on Facebook.

5.2

In the event of the ball machine not being available, the online Google Random Number Generator will be used. This will be demonstrated live streamed on Facebook before entering the required numbers for that specific competition.

5.3

Due to the nature of the winning judgement there will only be one winner per competition.

5.4

Velocity Competitions Ltd will attempt to contact Winner(s) using the telephone numbers and email address provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant’s sole responsibility to check and update these details. If for any reason they are taken down incorrectly, Velocity Competitions Ltd will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.

5.5

Once a winner is drawn they will own the prize offered in the competition and we will make every effort to contact them until the prize is delivered. Under no circumstance will the prize be forfeited.

5.6

In the event that the Velocity Competitions Ltd closes a Competition early, the Winner will be selected from all valid and eligible entries received by Velocity Competitions Ltd prior to the date of closure.

5.7

All Entrants are automatically entered onto Velocity Competitions Ltd database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by Velocity Competitions Ltd.

5.8

All prizes will be drawn regardless of ticket sell out on the guaranteed draw date as set/shown on the website. Cash alternatives are not offered in place of prizes. Draws are not extended past the guaranteed draw date.

6. WINNER’S DETAILS

6.1

All Winners will be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by Velocity Competitions Ltd in connection with the Competition and in identifying them as a winner of a Competition.

6.2

If the winner really does not want a photo taken then we will respect that but for the good of the competition and benefit of other entrants a photo of the winner and their prize would be appreciated.

6.3

Following receipt and verification of the details requested above by Velocity Competitions Ltd, the Winners will be contacted in order to make arrangements for delivery of the prize.

7. COMPETITION PRIZES

7.1

Velocity Competitions Ltd prizes are determined, selected by the managing directors of the company and are owned by Velocity Competitions Ltd from the date of the competition going live on the website to the date that the winner receives the prize. All prizes are picked and purchased by Velocity Competitions Ltd and in that case this is the prize the winner will receive. Details of each prize can be found on the website on the competitions pages. Velocity Competitions Ltd take no responsibility of the prize awarded after delivery, once the winner receives the prize Velocity Competitions Ltd does not insure the prize. No insurance comes with the prizes and Velocity Competitions Ltd cannot be held responsible for the prize once handed over to the winner.

7.2

Delivery to the Winner is free to any location in mainland UK. The promoter has a right to charge the Winner delivery fees if the Winner wants the Prize delivered anywhere outside mainland UK. All entrant expenses are the sole responsibility of the Winners.

7.3

The Prize must be accepted as referred to in 7.2 above, is non-transferable or convertible to substitutes, and cannot be used in conjunction with any vouchers, offers or discounts, including without limitation any vouchers or offers of the Promoter or Prize suppliers.

7.4

All prizes are subject to the terms and conditions of the prize provider, manufacturer or supplier.

7.5

All expenses incurred by the Entrants in entering the Competitions are the sole responsibility of themselves even if an Entrant then becomes a Winner.

7.6

The Promoter can store the Prize free of charge for 30 days after notifying the Winner at the Winner’s request, thereafter the Prize will be delivered to the Winner.

8. WINNERS PERSONAL DATA

8.1

By entering a Competition, and subject to your ticking the relevant box to indicate your consent to same and to your rights as provided under current data protection legislation and to our data protection policy and legislative compliance as detailed below, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses that are approved in writing in advance by the Promoter) and as reasonably required by the Promoter if you are declared a Winner.

9. LIMITS OF LIABILITY

9.1

Velocity Competitions Ltd makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of Velocity Competitions Ltd, Velocity Competitions Ltd shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by Velocity Competitions Ltd, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by Velocity Competitions Ltd.

10. ELECTRONIC COMMUNICATIONS

10.1

No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes.

10.2

Velocity Competitions Ltd shall use its best endeavours to award the prize for a competition to the correct entrant. If due to reasons of hardware, software or other computer related failure or due to human error the prize is awarded incorrectly, Velocity Competitions Ltd reserves the right to reclaim the competition prize and award it to the correct entrant, at its sole discretion and without admission of liability.

10.2.1

The Promoter shall not be liable for any economic or other consequential loss suffered or sustained by any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and Website used to operate the Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any Competition entries that occur as a result of malfunctioning software or other event. 10.3

In the event that Velocity Competitions Ltd closes a Competition early, the Winner will be selected from all valid and eligible entries received by Velocity Competitions Ltd prior to the date of closure, except that Velocity Competitions Ltd reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, Velocity Competitions Ltd will give all entrants Game Credit to enable them to replay equivalent tickets in a subsequent competition. Velocity Competitions Ltd also reserves the right at its sole discretion to extend the closing date of any Competition. Velocity Competitions Ltd shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.

10.4

Velocity Competitions Ltd shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems, however displayed or calculated, shall be entered into the relevant Competition and Velocity Competitions Ltd shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.

10.5

All Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of the Competition, as well as any future Promotions or Competitions offered by the Promoter.

10.6

The Promoter will only process or hold your personal information as set out in the terms and privacy policy annexed hereto in Appendix A

10.6.1

APPENDIX A DEFINITIONS : Data Protection Legislation: (i) unless and until the GDPR is no longer directly applicable in the UK, the General Data Protection Regulation ((EU) 2016/679) and any national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK and then (ii) any successor legislation to the GDPR or the Data Protection Act 1998.

10.7

In any event, any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter only to administer the Competition and determine award of Prizes where applicable. In order to process, record and use your personal data the Promoter may disclose it to
(i) any credit card company whose name you give;
(ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you;
(iii) any person to whom the Promoter proposes to transfer its business or any part of it;
(iv) comply with any legal or regulatory requirement of the Promoter in any country; and
(v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be-adequately protected during the course of such transfer.

11. DATA PROTECTION

11.1

Without prejudice to the provisions as to in particular consent by the Entrant and the Winner as specified in the main body of the Promoter’s terms and conditions to which this appendix is attached, the Entrant and the Winner will ensure that he has all necessary appropriate consents and notices in place to enable lawful transfer of the Entrant’s/Winner’s personal data (“Personal Data”) to the Promoter for the duration and purposes of these terms and conditions. Without prejudice to the foregoing, the Promoter shall, in relation to any Personal Data processed in connection with the performance by the Promoter of its obligations under these terms and conditions:

11.1.1

Process that Personal Data only on the written instructions or with written consent of the Entrant or Winner (which consent is provided initially in any event by the Entrant ticking a specific box in making an entry to the Competitions), unless the Promoter is required by the laws of any member of the European Union or by the laws of the European Union applicable to the Promoter to process Personal Data (Applicable Laws). Where the Promoter is relying on laws of a member of the European Union or European Union law as the basis for processing Personal Data, the Provider shall promptly notify the Customer of this before performing the processing required by the Applicable Laws unless those Applicable Laws prohibit the Promoter from so notifying the Entrant or Winner;

11.1.2

Process the Personal Data only for the purpose set out in the main body of these terms and conditions;

11.1.3

Ensure that it has in place appropriate technical and organisational measures, which may be reviewed and approved by the Entrant or the Winner, to protect against unauthorised or unlawful processing of Personal Data and against accidental loss or destruction of, or damage to, Personal Data, appropriate to the harm that might result from the unauthorised or unlawful processing or accidental loss, destruction or damage and the nature of the data to be protected, having regard to the state of technological development and the cost of implementing any measures (those measures may include, where appropriate, pseudonymising and encrypting Personal Data, ensuring confidentiality, integrity, availability and resilience of its systems and services, ensuring that availability of and access to Personal Data can be restored in a timely manner after an incident, and regularly assessing and evaluating the effectiveness of the technical and organisational measures adopted by it);

11.1.4

Ensure that all personnel who have access to and/or process Personal Data are obliged to keep the Personal Data confidential; and

11.1.5

Not transfer any Personal Data outside of the European Economic Area unless the prior written consent of the Customer has been obtained and the following conditions are fulfilled:

11.1.5.1

the Customer or the Promoter has provided appropriate safeguards in relation to the transfer;

11.1.5.2

the Data Subject has enforceable rights and effective legal remedies;

11.1.5.3

the Promoter complies with its obligations under the Data Protection Legislation by providing an adequate level of protection to any Personal Data that is transferred; and

11.1.5.4

the Promoter complies with reasonable instructions notified to it in advance by the Entrant or Winner with respect to the processing of the Personal Data.
